Purpose and Scope of Assignment:

The consultant will be required to review the legal, policy and institutional framework governing refugee work in Egypt. A desk review of available information on this will be a vital component of the study. The consultant is expected to consult with key stakeholders including private sector entities, academia, humanitarian agencies, and, to the extent possible, government officials and public institutions.
The expected outcome is an in-depth analysis of the legal, policy and institutional framework governing refugee work and actual practice. The consultant will also be required to provide clear recommendations on how the right to work can be actualized within the law for refugees and asylum seekers. This study is expected to contribute to consistent messaging on UNHCR’s persons of concern’s entitlements to work in Egypt and on practical ways how to foster their employment.
Duty station: Cairo, with possibility of travel to Alexandria and Damietta, Egypt

Tasks and responsibilities include:
 
(a) Review the legal, policy and institutional framework on the right to work in Egypt and;
i. Discuss entitlements refugees and asylum seekers have under relevant domestic laws
ii. Outline procedures and documents required to obtain work permit / access micro-finance
iii. Elaborate on convergence between law and practice
(b) Review the legal, policy and institutional framework on access to finance for refugees and asylum seekers.
(c) Review regional and bilateral agreements signed between Egypt and any other countries from which refugees and asylum seekers in Egypt originate (e.g. September 2004 Four Freedoms Agreement between Egypt and Sudan; legal framework for Libyan nationals in Egypt) and review provisions on work.
(d) Outline requirements for practice of “liberal professions” (law, medicine, architecture, engineering etc) by non-nationals including entities involved and examinations, approvals, licences and permits to be obtained.
(e) Outline how refugees and asylum seekers from different nationalities access employment in practice, including time frame of contracts, entitlements, working conditions, registration of businesses, business and investment permits. Analyse which procedures and documents are required for wage employment and self-employment in the process, including for the area of telework.
(f) Outline how refugees and asylum seekers from different nationalities access finance in practice and which procedures and documents are required in the process.
(g) Recommend opportunities within the legal, policy and institutional framework in Egypt for refugees and asylum seekers to access work/employment, including telework in and outside Egypt, and finance.
(h) If necessary, consider and propose in light of the legal framework, appropriate mitigation measures to promote safe work for refugees and asylum seekers in Egypt.
(i) In accordance with the law and considering requirements for registration, certification, partnerships and staff employment, propose guidelines for refugees and asylum seekers to establish a business.
(j) Review legal instruments in the region guaranteeing the right to work for refugees and asylum seekers (recent examples from Turkey and Jordan) and highlight lessons for Egypt.
(k) Review perspectives of employers on the required percentages of foreign workers & costs incurred, levels of specialised skills and sectors with ease of entry for foreigners.
(l) Draft and present a final report on the findings.
(m) Carry out other functions as may be necessary or incidental to the foregoing.
Payment schedule:
30% after submission of mid-term report and presentation, 40% after presentation of findings, 30% after approval of final report. Reimbursement of travel costs after submission of travel documentation.
